1. Agreement
These Terms of Use (“Terms”) govern your use of the Daily Health Coach mobile application, website, and related services (the “Service”), provided by Darius Harrison. By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 13 and legally able to enter this agreement. If you are under the age of majority where you live, a parent or legal guardian must approve your use. You are responsible for accurate account information, safeguarding your device and sign-in methods, and activity under your account. Notify us promptly if you believe your account has been compromised.
3. Fitness, nutrition, and health guidance
The Service provides general educational and wellness information. It is not a medical device and does not provide medical diagnosis, treatment, emergency services, or professional healthcare advice. AI responses and fitness or nutrition suggestions may be incomplete, inappropriate, or wrong. Consult a qualified professional before changing exercise, diet, medication, or treatment, especially if you have a health condition, are pregnant, or experience pain or concerning symptoms. In an emergency, contact local emergency services.
4. AI features
The Service uses artificial intelligence to generate responses and plans. You are responsible for reviewing output before relying on it. You grant us permission to process the prompts, feedback, and context you provide solely to operate, secure, and improve the Service as described in the Privacy Policy. You remain responsible for your content and must have the right to submit it.
5. Subscriptions and billing
Paid features may be offered through auto-renewable App Store subscriptions. The paywall displays the subscription period and price before purchase. Payment is charged to your Apple account after you confirm the purchase. Unless you cancel before renewal, the subscription renews automatically at the disclosed price and period. Any free trial converts to a paid subscription unless canceled before the trial ends.
Manage or cancel your subscription in your Apple account’s subscription settings. Apple processes payments, cancellations, and refunds under its rules. Deleting your Service account does not cancel an App Store subscription. Features and prices may change prospectively with any notice required by Apple or applicable law.
6. Acceptable use
You may not:
- Use the Service unlawfully or to harm, threaten, defraud, or impersonate another person.
- Attempt to gain unauthorized access, bypass security or subscription controls, or disrupt the Service.
- Upload malware, scrape the Service at scale, or reverse engineer it except where law expressly permits.
- Use AI features to violate another person’s privacy, intellectual property, or other rights.
- Present generated health guidance as professional advice without qualified review.
7. Third-party services
The Service interoperates with providers including Apple, Clerk, OpenAI, and PostHog. Your use of their services may be governed by separate terms. We are not responsible for third-party services, outages, data accuracy, or changes outside our control. You can disconnect optional integrations where the app provides that control.
8. Ownership
We and our licensors retain all rights in the Service, including software, design, branding, and documentation. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service. These Terms do not grant rights to our trademarks or other intellectual property.
9. Suspension and termination
You may stop using the Service or delete your account at any time. We may restrict or terminate access when reasonably necessary to address a Terms violation, security risk, legal requirement, or material harm to the Service or others. Provisions that by their nature should survive termination will survive.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, availability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from reliance on AI, health, fitness, or nutrition content. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
11. Changes and contact
We may update these Terms as the Service changes. Updated Terms will show a new effective date, and we will provide additional notice when required. Continued use after the effective date means you accept the updated Terms. For questions, visit our Support page.
